Branding Design

Unless specifically agreed otherwise in writing, all quotes by Pete Buttecali include one presentation round of a range of 3 to 5 visual design concepts in digital PDF format delivered via email for each included design component (logo, sub-brand, icon, etc.). One additional round (beyond the initial presentation) including one additional design concept (or set of edits to a selected concept) is also included in quoted fees, along with incidental final “tweaks” (included at Pete Buttecali’s discretion). All rounds of significant edits or new creative required beyond these provided for will be quoted separately and billed additionally, after prior client notification and approval. 

 

Web

Pete Buttecali does not offer or provide any sort of web or software development, programming, coding, web hosting, website maintenance, data management or any other form of software- or internet-related support or service, and any such technical support required by the client to complete a given effort in which Pete Buttecali is involved creatively will be the sole concern of the client. The client will be responsible for contracting directly with third-party resources for any type of support on such components and services. Pete Buttecali will only provide static 2D image files in standard industry digital formats (.pdf, .jpg, etc.). 

 

Proofing

The client accepts full responsibility for proofing all content for grammatical and factual correctness. Although internal proofing measures are performed for better quality assurance purposes, Pete Buttecali will in no way be held responsible for any sort of content error (grammatical, factual, or otherwise) appearing in the client’s website or related marketing or communications. These stipulations remain in effect even in the event that the client requests for Pete Buttecali to review and comment on any sort of proof (digital or physical) prior to final printing, manufacturing or production.

 

Copyrights/Ownership

Upon full payment of all invoices submitted for a given project, the client will be transferred full and unfettered ownership rights pertaining to the final creative developed by Pete Buttecali which is selected by the client for that specific project. Pete Buttecali retains full ownership rights pertaining to any creative produced for a given project — deemed Pete Buttecali’s Intellectual Property — until all invoices for that project have been paid in full. Additionally, in perpetuity and without exception (unless otherwise specifically agreed to in writing), Pete Buttecali solely retains all copyrights and ownership rights pertaining to any and all Intellectual Property proposed for a given project but unselected by the client for use in that specific project — such Intellectual Property includes, but is not limited to, creative, verbiage/text, concepts, sketches, designs, code, logos, typographical executions, icons, symbols, illustrations and/or photo illustrations. 

 

Content/Copywriting

Pete Buttecali is capable of Writing and Editing brief elements of branding and advertising such as corporate/product/service/program names and slogans, headlines, theme lines, short ad copy, etc., but such support is quoted and billed separately. No such Writing and Editing will be guaranteed or included in quoted project fees unless specifically listed as a deliverable.

 

Miscellaneous Expenses

In all quotes and proposals, no sort of print, duplication, reproduction, scanning, shipping/delivery/mailing, travel/lodging, manufacturing, or any other sort of non-creative expense related to a given client project is included in quoted fees and any such costs are the sole concern of the client. Any and all such expenses required for a given client project are the sole concern of the client. 

 

Payment

Unless mutually agreed to in writing, a 1/2 advance invoice will be submitted against total quoted creative fees upon client approval, and will be due as a non-refundable deposit upon receipt prior to Pete Buttecali being obligated to present any creative or perform any services. The remaining 1/2 balance of all pre-approved fees, expenses, and out-of-scope services costs will be invoiced upon the client receiving final deliverables with payment due within 30 days.

 

Approval

In order to commission Pete Buttecali to begin work, an authorized employee or agent of the client may simply email to confirm full agreement with all stipulations included in the project-specific quote provided by Pete Buttecali. By paying the above-mentioned deposit, the client thereby agrees to be bound by all of the terms and conditions detailed on this page.
